Selling or Licensing Your Story for Television Show or Film – HegdeSimplifies
An author of a story or a screenplay looking to pitch to a producer for a tv show or film must be mindful of securing the copyright registration first. A registered copyright gives legitimacy to the author’s ownership rights. Depending on the type of story, particularly true or life stories where living people, celebrities or well know figures, are involved, the author should acquire if feasible, no objection certifications to avoid claims, particularly defamation or personality rights, at a later stage. Before pitching to a producer, an Non Disclosure Agreement (NDA) should be executed to protect the exchange of confidential information. However, the NDA or the copyright will not protect the concept behind the story or screenplay, only the expression of the concept in the form of a written story or screenplay is protectable. If the producer is interested in the story, an option agreement will be executed where for a given period of time the producer will explore the feasibility of the story for a tv show or movie. During the option period the author will be restricted from pitching or selling the story to others. If the story is feasible for the producer, they will opt to license or acquire the copyright and the rights of exploitation from the author in the form of a purchase agreement.
